Lori Berman, Robin Bartleman File Legislation to Protect Sexual Assault Victims’ Privacy and Anonymity
The measure is designed to plug a loophole in current state law that allows the names or identifying information of survivors who report such crimes to others, including employers and schools, to be disclosed, including information or records created for a potential case against the perpetrator. Perpetrators or other third parties who may be responsible can also threaten public exposure of the survivor’s identity in order to discourage reporting of the crimes to law enforcement, school administrators, employers and others.
Berman’s office insisted the bill will “allow school authorities to identify students who may not know how to swim and will help put these parents, where needed, in touch with free or low-cost programs to ensure their child has an opportunity to learn, presuming there is a desire” and will let parents opt-out if they so choose.
This marks the third year in a row where the legislators have pushed the bill.
State Sen. Lori Berman, D-Delray Beach, and state Rep. Joe Casello, D-Boynton Beach, offered a bill to create the system for “when an adult with a cognitive, developmental or intellectual disability goes missing, and whose disappearance is a credible threat of immediate danger or serious bodily harm to themselves" which would largely follow the “‘Silver Alert’ activation system, which is deployed when a senior citizen is missing and presumed in danger.”
Farmer also unveiled his leadership on Tuesday.
U.S. Reps. Ted Deutch, D-Fla., Lois Frankel, D-Fla., Alcee Hastings, D-Fla., and Brian Mast, R-Fla., signed the letter. So did state Sens. Lori Berman, D-Boynton Beach, Gayle Harrel, R-Stuart, Bobby Powell, D-West Palm Beach, and Kevin Rader, D-Boca Raton, along with nine members of the Florida House.
